For the purposes of this policy the controller is Mojo US Inc (“Mojo,” “we,” “us,” or “our”).
Mojo has prepared this Consumer Health Data Privacy Policy (“Consumer Health Policy”) to explain how we collect, use, process, share and otherwise handle Consumer Health Data in connection with your use of our website, our app or any other means whereby we may provide our services, such as digital courses (the “Platform”), and the choices and rights available to you under applicable U.S. consumer health data privacy laws, including the Washington My Health My Data Act and Nevada’s consumer health data privacy law.
This Consumer Health Policy is intended to supplement our general Privacy Policy. In the event of any conflict between this Consumer Health Policy and our general Privacy Policy with respect to Consumer Health Data, this Consumer Health Policy will apply.

This Consumer Health Policy applies to consumers in Washington and Nevada to the extent their Consumer Health Data is collected by us and does not apply to individuals acting in an employment context.

1. Categories of Consumer Health Data We Collect
We may collect the following categories of Consumer Health Data:
- Health and wellness information you choose to provide through your interactions with the Platform, including responses to questions, questionnaires, quizzes, onboarding flows, digital courses, chatbot interactions, discussion forums, surveys and support enquiries.
- Special category data concerning your health and sex life.
- Information relating to telemedicine interactions, including information about products you acquire and relevant details arising from support enquiries.
- Inferences derived from information you provide, where such inferences relate to your health status and constitute Consumer Health Data.
2. Sources of Consumer Health Data
We may collect Consumer Health Data from:
- You directly (e.g., onboarding, chatbot, courses, forums, support requests, telemedicine interactions);
- Your interactions with the Platform and
- Third-party telemedicine providers and pharmacies, where relevant to services you request.
3. Purposes for Collection and Use
We collect and use Consumer Health Data to:
- Provide and operate the Platform and requested services;
- Enable participation in features (courses, chatbot, questionnaires);
- Respond to enquiries and provide support;
- Facilitate telemedicine services;
- Improve the Platform and services;
- Ensure safety and service quality;
- Prevent fraud and ensure security; and
- Comply with legal obligations.
We only collect Consumer Health Data:
- with your consent where required; or
- where necessary to provide a service you request.
4. How We Process Consumer Health Data
We process Consumer Health Data for the purposes described above and in accordance with applicable law.
Where required:
- we obtain consent for collection; and
- we obtain separate consent for sharing, unless an exception applies.

- Health and wellness information you provide;
- Information from chatbot, courses, questionnaires or telemedicine interactions; and
- Limited service-related data necessary to provide requested services.
6. Sale of Consumer Health Data
We do not sell Consumer Health Data without valid authorisation.

Subject to applicable law, consumers in Washington and Nevada may have the following rights in relation to their Consumer Health Data:
- Right to access / know: you have the right to confirm whether we are collecting, using, sharing or selling your Consumer Health Data and to access such data.
- Right to delete: you have the right to request that we delete your Consumer Health Data, subject to certain legal exceptions.
- Right to withdraw consent / cease processing: where we rely on your consent, you have the right to withdraw that consent at any time. You may also request that we cease collecting, sharing or selling your Consumer Health Data, where applicable.
- Right to know third-party disclosures: you may request a list of the third parties with whom we have shared or to whom we have sold your Consumer Health Data, where required by applicable law.
We will not discriminate against you for exercising any of your rights.

To exercise your rights, you may:

- use any data request tools or support channels made available through the Platform.
We will take steps to ensure that requests are submitted and processed through secure and reliable means, and we may require you to provide information necessary to verify your identity before acting on your request.
You are not required to create a new account in order to exercise your rights, although you may be asked to use an existing account where appropriate.
We will respond to your request in accordance with applicable law.

You may appeal by contacting support@mymojo.com with “Consumer Health Data Appeal” or use any tools or support channels made available through the Platform.

We implement:
- Need-to-know access controls;
- Confidentiality obligations; and
- Industry-standard security safeguards.
13. Changes to This Consumer Health Policy
We may update this Consumer Health Policy from time to time.
If we make material changes, we will notify consumers whose Consumer Health Data we collect by:
- posting the updated Consumer Health Policy on this page;
- updating the “Last updated” date above; and
- where required by applicable law or where appropriate, providing notice through the Platform or by other direct means (such as email or in-Platform notification).
